Election Petition: Filing for subpoena won’t help the Petitioner- Constitutional Lawyer

Constitutional Lawyer, Lawyer Kofi Bekai has stated that, the filing of subpoena by the Petitioner, John Dramani Mahama against the Chairperson of the Electoral Commission, Mad. Jane Mensah will not help him win his case at the Supreme Court.

Lawyer for the petitioner in the ongoing election petition, Tsatsu Tsikata had filed a motion of leave to re-open their case in the 2020 election petition, to enable the chairperson of the Electoral Commission, Jean Mensa testify in court.

Their motion comes after the Supreme Court ruled that the chairperson will not undergo cross-examination.

The court, presided over by Chief Justice Anin Yeboah said “we are not convinced and will not yield to the invitation being extended to the court by the counsel for the petitioner to order the respondents to enter the witness box in order to be cross-examined.”

Lawyer Bekai speaking in an interview said, lead council for the Petitioner, Lawyer Tsatsu Tsikata cannot cross examine Mad. Jane Mensah if the Judges approve the motion.

According to him, Jane Mensah will become a witness for the petitioner and it will be very difficult for Jane Mensah to testify in favor of the petitioner.
